The Client agrees that once a new event date is chosen, 25% of the original balance of Total Service Fee is due on the original Agreement due date, and the remaining 25% balance is due one week prior to the new event date. The new event date must occur within 12 months of the original wedding date, otherwise the Agreement becomes voided and Michael Farmer Photography is not obligated to provide services, and Client will be responsible for cancellation policies outlined in this Agreement. Should, for any reason, the date of the event change or be postponed, best efforts will be made by Michael Farmer Photography to accommodate the new date one time. The Client further agrees that if the cancellation or postponement of the event is done within 60 days before the event, the reasonable liquidated damages are all monies, including, but not limited to, the retainer that has been paid to Michael Farmer Photography and are not refundable.
Therefore, the Client agrees that if Client cancels or postpones the event 60 days or more before the event, that reasonable liquidated damages is the initial retainer payment made by the Client is not refundable. The Client agrees that it would be difficult to ascertain the damages suffered by Michael Farmer Photography as a result of a cancellation or postponement of the event. If the event is cancelled or postponed, Michael Farmer Photography suffers a loss. Once Michael Farmer Photography reserves a date/time for the Client, it ceases attempting to sell its services for this date/time to others. Half of Total Service Fee is due at time of contract signing balance is due seven days prior to event. Retainer Payments / Liquidated Damages // No part of any order will be delivered until the balance is paid in full. Client may use footage for personal use only. This copyright excludes anyone except Michael Farmer Photography from making identical or substantially similar copies of the work, from creating adaptations or derivatives of the original work, from re-selling the work in any way, and from displaying the work publicly or as a for-profit marketing/advertising technique. Client further grants the right and permission to use and/or publish said digital images, either in original or computer-altered format, in conjunction with client’s own or a fictitious name, in any reproduction through any media for any purpose, forever. Michael Farmer Photography shall have the exclusive right to make reproductions for the Photographer’s portfolios, samples, self-promotions, advertisements, entry in photographic contests or art exhibitions, editorial use, for display within or on the outside of the photographer’s studio, including the Internet.
Copyright and Reproductions | It is agreed that Michael Farmer Photography shall own the copyright to all images and footage created through this contract.
